GENERAL TERMS AND CONDITIONS OF BERTH RESERVATION
Introductory note
Setting new standards in nautical tourism, adriatica.net d.o.o. brings marinas and navigators together over the Internet, and is a mediator between the customer and the mooring service provider; navigators and marinas, harbors or moorings. These General Terms and Conditions are an integral part of the Contract concluded between adriatica.net d.o.o. and the customer using the mooring service.
In accordance with these General Terms and Conditions, the customer using the mooring service is any natural or legal entity which has, by mediation of adriatica.net d.o.o., made a Contract and payed in for the reservation of the mooring service, and the mooring service provider is any natural or legal entity - marina, harbor, mooring, etc., that provides mooring service for the customer.
Mooring reservation and payment
The customer may personally reserve and pay in for mooring via www.marinanet.hr, or through an agency which made a special contract with adriatica.net d.o.o. for business colaboration.
The customer pays the full price of the reservation set by adriatica.net d.o.o., and the full price of the mooring service set by the marina/harbor/mooring, except for marinas/harbors/moorings for which a different way of payment (e.g. paying for the mooring in the marina on arrival) has been explicitly specified on www.marinanet.hr.
In the case of making a contract over the Internet via www.marinanet.hr, the contract is made at the moment of the customer's credit card authorization.
Having made a contract over the Internet, the customer recieves a receipt for payment for the reservation and mooring in electronic form by e-mail.
By entering their credit card number on the web page www.marinanet.hr, or by dictating their credit card number when purchasing by phone, or signing the contract, the customer fully accepts these General Terms and Conditions, having read them carefully, as well as the general terms and conditions of the marina/harbor/mooring for which they had made a reservation and payed in for the mooring service.
The amount is stated in KN. All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian kuna according to the current exchange rate of the Zagrebačka banka d.d.
When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated in our web site.
Mooring in marinas/harbors/moorings
The marina, harbor or mooring is obliged to watch after the berths, take vessels in and provide mooring services to the customer who has reservered and payed for the mooring service via www.marinanet.hr.
On arrival at the marina/harbor/mooring, the customer is obliged to act in accordance with the instructions recieved on the receipt for payment for the reservation and mooring, and follow the regulations on order in that particular marina/harbor/mooring. The arrangement of vessels in a certain marina/harbor/mooring is determined by the marina/harbor/mooring's staff.
adriatica.net d.o.o. obligations
As the mediator, adriatica.net d.o.o. is obliged to take care of the choice of service providers with the care of a good businessman and to take care of the customer's rights and interests in compliance with good business practice. The mooring service provider is obliged to watch after the berths, take the vessels in and provide the customer mooring services, which have been sold to the customer in his name and for his account by adriatica.net d.o.o.. adriatica.net d.o.o. will fulfill all the mentioned obligations entirely, except in the event of Force Majeure or changed circumstances, but is not held responsible for the obligations of the mooring service provider. adriatica.net d.o.o. assumes no responsibility for the accuracy, reliability or promptitude of any content of the website which has been taken from a third party (such as: marina information, nautical maps, etc.), as well as the accuracy, reliability or promptitude of the content of linked pages.
Customer's obligations
The customer is obliged to follow the regulations on order in the marina/harbor/mooring and cooperate with the mooring service provider's representative. The customer is obliged, when making the reservation, to give their e-mail address or phone number at which they can be reached on the day of mooring. The customer will personally be held responsible for any possible damage they might cause in failure to abide by the rules set forth by this contract.
Cancellation policy
If a customer cancels the Contract, adriatica.net d.o.o. will keep, and the customer renounce the return payment of the following amounts from the full price:
a) up to 30 days before arrival, 10% of the full service price, but not less than 100kn
b) 29 - 15 days before arrival, 25% of the full service price, but not less than 100kn
c) 15 - 7 days before arrival, 50% of the full service price
d) 7 - 0 days before arrival, 100% of the full service price
The stated costs of cancellation will also apply on changes of the arrival date, as well as on all other significant changes.
For every cancelled reservation the Agency charges a fee of 25 Euro for handling expenses. In the event the total amount of the reservation is under 50 Euro, the Agency charges a fee of 10 Euro for handling expenses.
Cancellation by adriatica.net d.o.o. / Inability to provide service
In the case of unpredictable circumstances taking place, that cannot be avoided or dealt with, adriatica.net d.o.o. reserves the right to cancel the mooring services, not less than 5 hours before the time stated by the customer as the expected time of arrival. Possible cancellation of the service will be done by adriatica.net d.o.o. by phone and e-mail, on the phone number and e-mail address stated by the customer in the reservation. The customer is familiar with and acknowledges that in the event of extraordinary situations such as extremely bad weather conditions due to which marinas are, for safety reasons, obliged to take in any vessel, there might be an overload of the capacity of the berths and the inability to provide the services contracted for.
If there is any possibility, adriatica.net d.o.o. and the service provider will offer the customer a suitable substitute solution, which the customer can, but is not obliged to, accept.
On every event of cancellation or the inability to provide service, the customer holds the right to get return payment of the full price that had been paid in, however the customer will get no damage compensation.
Complaints and disputes
It is in the customer's best interest to enter their complaint in the book of complaints of the marina/harbor/mooring that contracted for the mooring service with the customer through adriatica.net d.o.o.. The mooring service provider will make an attempt to provide with the service contracted for, i.e. correct the possible mistakes and consider the complaint in compliance with good business practice and their own business terms and conditions. Attempts will be made by the parties to resolve disputes in mutual agreement, and, on the contrary, they will stipulate the competence of the court in Zagreb.
Protection of the customer's personal information
The customer gives out his personal information on his own will. The customer's personal information is required for the process of realisation of the service and will be used for further communication between the parties. Customer's personal information will be kept in adriatica.net d.o.o. database, and the customer acknowledges that they may be used for the market activity of adriatica.net d.o.o..
On the behalf of adriatica.net d.o.o., we oblige ourselves to secure the privacy of all our customers. We gather only the essential, basic information on customers and inform them of its usage. Regularly, we give the customers the possibility to choose on how their information will be used, including the possibility to choose whether they prefer to have their name taken off the lists used for marketing campaigns or not. All information on the customers is kept strictly confidential, and is accessible only to the employees to whom the information is necessary for doing their work. All employees of adriatica.net d.o.o. and their business partners are held responsible for abiding by the rules of protection of privacy.
